Internal complaints procedure

JobFunders is managed by JOBFUNDERS BV, with registered office at 8550 Zwevegem, Meidoornstraat 11 and registered in the Register of Legal Entities under number 0567.877.194 (hereinafter 'JobFunders').

This complaints procedure applies to any use of the JobFunders application or any collaboration with the employees or partners of JobFunders.

General

Who can file a complaint?

  • Employers
  • Job seekers
  • Employees
  • Persons or organizations with whom JobFunders has a cooperation agreement
  • Governments / other agencies

Content of complaint

Any complaint must concern the operation of JobFunders or actions taken by employees of JobFunders. A complaint may also be filed regarding persons or organizations with which JobFunders has a cooperation agreement.

Inadmissible complaints

  • General complaints regarding regulations;
  • General complaints regarding the policy pursued or not;
  • The complaints concern policy intentions or statements;
  • They relate to facts regarding which a complaint was previously filed which was already handled in accordance with the complaints decree;
  • They relate to facts that occurred more than 1 year prior to the filing of the complaint;
  • They relate to facts regarding which all organized administrative appeal options have not been exhausted or regarding which a judicial appeal is pending;
  • The complaints are manifestly unfounded;
  • If the complainant cannot demonstrate an interest;
  • Anonymous complaints;

Complaints procedure

In accordance with the Decree of 1 June 2001, granting a right of complaint against administrative bodies, the complaints procedure is accessible and of high quality.

If a complaint is submitted, JobFunders registers it via a computer program.

Within seven working days, the complainant will receive a letter stating either who will handle the complaint within JobFunders (admissible complaint) or to which authority the complainant must turn (inadmissible complaint). The statutory time limit for this is ten days.

If JobFunders proceeds to handle the complaint, the complainant will receive a letter containing the response to the complaint within twenty working days. If the complaint handler requires more time, they will inform the complainant accordingly. The statutory time limit for handling a complaint is set at forty-five days after receipt of the complaint. Cf. Decree of 1 June 2001 granting a right of complaint to administrative bodies.

If the complainant is not satisfied with the proposal, the complainant may lodge an appeal.

If JobFunders does not handle the complaint further, the complainant may turn to the authority identified on the letter from the complaints department.

If the complainant is not satisfied with the manner in which the complaint was handled, the complainant may lodge a written complaint against this with the Flemish Ombudsman Service.

Complaints procedure for complaints regarding violence, bullying, and unwanted sexual behavior.

Job seekers are equated with employees under Chapter 1, Article 2, § 1 of the Welfare Act of 4 August 1996.

The procedure provided for handling complaints regarding violence, harassment, and unwanted sexual behavior is framed within the Act on Protection against Violence, Harassment, and Unwanted Sexual Behavior at Work of 11 June 2002.

If a job seeker wishes to file a complaint regarding violence, harassment, or unwanted sexual behavior, the job seeker may file either a formal or an informal complaint.

The formal complaint is submitted to the external prevention advisor; the complainant can file an informal complaint with JobFunders, where either the internal complaints procedure will be followed or the assistance of the external prevention advisor will be enlisted to mediate on behalf of the complainant.

Informal complaint

In the case of an informal complaint, JobFunders will investigate what is going wrong, and the complainant may (if desired) involve the external prevention advisor. The primary intention is to determine what went wrong and how JobFunders can resolve this internally.

Formal complaint

During the formal proceedings, the complainant officially files a complaint via the external prevention advisor or medical inspectorate, or initiates legal proceedings. To do so, the complainant must complete the necessary paperwork and sign declarations. The complainant has no further direct contact with JobFunders, but the agency provides us with the file.
