This Privacy Statement applies when you use the website www.jobfunders.com visits or when you register on the Jobfunders.com platform or JobFunders app. This explains why and how JOBFUNDERS BV (hereinafter referred to as “JobFunders”, “we” or “us”) processes your personal data when you use our services.

JobFunders reserves the right to modify or revise this Privacy Statement from time to time. If you are registered via the website or the app, we will notify you before these changes or revisions take effect. 

2. Visit to the website or app 

When you visit our website or app, personal data may be collected from you under certain circumstances using cookies (see our [link to privacy policy] regarding this). cookie statement). 

Furthermore, via our website or app, you have various ways to share personal data with us. For example, you can subscribe to our newsletter or fill out a contact form. 

In these cases, we request the information necessary to provide you with the desired information, such as your name and email address. These processing activities are always based on your consent. You can withdraw your consent at any time by unsubscribing via the unsubscribe link at the bottom of every email you receive in the context of the above processing purposes. 

Our website or app also offers you the option to contact us via the chatbot. In that case, the data you leave there is processed. This processing falls within our legitimate interest, specifically responding to the questions you have asked. 

3. Jobfunders.com

3.1 Create account

If you register as a user, you can do so directly via your email address or via your LinkedIn, Google, or Facebook profile. If you register using these existing profiles, you acknowledge that certain information is exchanged between JobFunders and the relevant profile. You can find more information about this via the information button at the time of registration using this profile. 

If you register directly as a user, we collect your name, contact details, and other data necessary to complete your registration on Jobfunders.com or the JobFunders app. The type of data requested may differ depending on whether you register as a user for a Company or a Candidate. 

  • Company User: in that case, only your contact details are processed;
  • Candidate: on the one hand, your contact and identification details are processed, and on the other hand, all information that you add to your profile yourself, such as your CV, including references and any motivation. 

The processing of these personal data is necessary to execute the agreement between you and us regarding the use of Jobfunders.com or the app. If you do not wish to transfer these personal data to JobFunders, you cannot use Jobfunders.com or the app, as this processing is necessary to facilitate your access to and use of Jobfunders.com or the app. 

3.2 Use of Jobfunders.com

When you use Jobfunders.com (or app), we additionally collect the following personal data: 

  • Your communication with us (e.g. in the context of support) and data relating to logging in to Jobfunders.com (or app).
  • If you use Jobfunders.com (or app) as a Candidate, we keep track of which vacancies you view and which vacancies you respond to, or whether you add them to your favorites. 

We process this personal data for the following reasons:

  • Continuously improving our services and thereby developing new functionalities. The processing is based on our legitimate interest, in particular better aligning our services with the needs of our Users;
  • to keep Jobfunders.com (or app) safe for you and all our Users. This processing is based on our legitimate interest, specifically providing a safe platform for all parties involved;
  • To keep track of how Jobfunders.com (or app) is used and whether the Jobfunders.com (or app) Terms of Use are not being abused. This processing is compatible with the proper execution of the agreement between you and Jobfunders.com (or app). 

3.3 Coins 

If you become entitled to Coins and any associated prizes through the use of Jobfunders.com, we process your contact details, address details, and data relating to the claiming, possession, and use of Coins.

4. With whom do we share your personal data? 

Your personal data is processed solely for the purposes mentioned above.

If you register using your LinkedIn, Google, or Facebook profile, certain information will be shared with LinkedIn, Google, or Facebook, respectively. 

In addition, your data may be shared with other parties who also use our services, such as the potential employer if you respond to a vacancy from this employer. However, the exchange of personal data via Jobfunders.com (or app) while using the platform always takes place via the settings or actions you have selected. 

JobFunders may also call upon third parties in the context of the aforementioned purposes, such as for software integration (e.g. software suppliers) and hosting purposes (e.g. cloud providers, external data centers…).

Under no circumstances will your personal data be transferred to third parties for commercial purposes. 

Furthermore, your data is not transferred to countries outside the European Economic Area. Should this change in the future, we will ensure that we have taken the necessary appropriate safeguards and additional measures, as required by data protection legislation. 

5. How do we protect your personal data? 

JobFunders takes all reasonable technical and organizational measures to ensure the protection of your personal data so that it is protected against misuse, loss, or unauthorized access. For instance, access to your personal data is granted only on a “need-to-know” basis. These measures are always based on the current state of the art. However, the security and safety of your personal data is always a best-efforts obligation for which we cannot offer absolute guarantees. 

6. What are your rights and how can you exercise them? 

If you have a complaint, a question, or a problem regarding the way we process your personal data, you can contact us via the contact details as described in point 1.

If you contact us to exercise your rights, we will respond within 1 month. Exceptionally, this may take longer (up to a maximum of 3 months), but in that case, we will notify you within 1 month. Whether or not you can exercise your rights is always linked to the processing itself and the legal basis. 

If you wish to exercise your rights, we ask that you always clearly describe which right you wish to exercise and how (e.g. by email, by post…) you wish to obtain the requested information. Furthermore, we are subject to an identification obligation. We are required to verify whether you are effectively entitled to obtain the requested information; for this reason, we may request a copy of your identity card.  

Right of access and correction

If you would like to know which personal data JobFunders processes about you and for what purposes, please contact us. We can provide you with a free copy of the personal data we process about you. If you believe that your personal data is incorrect or outdated, you can request us to correct it. 

Right to removal and restriction

You have the right to request that we delete your personal data. However, if we are legally required to retain certain personal data for a longer period, we cannot comply with this request. In that case, we will notify you. 

If you have valid reasons to do so, you may request us to restrict the processing of your personal data. For example, because you dispute the accuracy of your data. 

Right of objection

When the processing of your personal data is based on our legitimate interest or falls within the scope of the performance of a task of public interest or of public authority, you may object to the processing of your personal data in a reasoned manner. 

Right to data portability

If we process your personal data based on your (explicit) consent or in the context of the performance of the agreement between you and us, you may request that we provide the personal data you have provided to us in a structured, commonly used and machine-readable format, or transfer it to another controller, provided that the processing is carried out by automated means. 

Right to withdraw your consent

When the processing of your personal data by JobFunders is based on your (explicit) consent, you have the right to withdraw this consent at any time. However, the withdrawal of your consent does not affect the lawfulness of the processing prior to the withdrawal of your consent. 

Right to file a complaint

You have the right to lodge a complaint with the Belgian supervisory authority if you have a complaint regarding the use of your personal data and you believe that you are not being sufficiently heard by JobFunders.

7. Duration of custody.

JobFunders retains personal data for as long as is necessary for the purpose for which it was collected or as required by law. The specific retention periods are as follows:

  1. Account details: Up to 10 years after the last activity on the platform.
  2. Candidate data: Up to 10 years after the last activity or until the user requests deletion.
  3. Communication data: 10 years after the communication has been handled.
  4. Data collected via cookies: See our Cookie Policy for specific timeframes.

If data is no longer needed, it will be deleted or anonymized. Users may request the deletion of their data at any time, unless there are legal obligations that require longer retention.
